Agreement Overview

These Terms and Conditions ("Terms") govern your use of the StratioFX trading platform and all related services ("Services"). By accessing or using our Services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you must not use our Services.

These Terms constitute a legally binding agreement between you ("User", "Client", or "you") and StratioFX ("Company", "we", "us", or "our"). We reserve the right to modify these Terms at any time, with changes becoming effective upon posting to our website. Your continued use after such changes constitutes acceptance of the modified Terms.

Legal Agreement

Compliance Required

Mandatory adherence to all terms for service access

Account Terms

The following terms apply to all user accounts on the StratioFX platform:

Eligibility

  • Age Requirement: You must be at least 18 years old to use our Services
  • Legal Capacity: You must have full legal capacity to enter into binding agreements
  • Jurisdiction: Not available in restricted territories (see Section 4.3)
  • Prohibited Persons: No access for individuals on sanctions lists or restricted by law
  • Professional Traders: Additional requirements apply for professional account designation

Registration

  • Accurate Information: Must provide complete and truthful details during registration
  • KYC Verification: Identity verification required before trading
  • Single Account: One account per individual/entity (except with written approval)
  • Security: Responsible for maintaining account confidentiality
  • Updates: Must promptly update any changes to account information

Security

  • Credentials: You are solely responsible for safeguarding login details
  • Unauthorized Access: Must immediately report any suspected unauthorized access
  • Two-Factor Authentication: Required for all accounts (when available)
  • Device Security: Must maintain security of devices used to access account
  • Liability: Responsible for all activities conducted through your account

Multiple Account Policy

General Rule: Only one personal trading account per user allowed.

Permitted Exceptions:

  • Verified corporate accounts (documentation required)
  • Approved institutional platform accounts
  • Family office/trust structures (compliance review)

Unauthorized multiple accounts subject to termination.

Termination

  • User Termination: May close account at any time by written request
  • Company Termination: We may suspend or terminate accounts for violations
  • Inactive Accounts: Dormant accounts may be closed after 12 months of inactivity
  • Effect: Termination doesn't relieve obligations incurred prior to termination
  • Funds: Remaining balances will be returned according to withdrawal policies

Important: Providing false information during registration constitutes a material breach of these Terms and may result in immediate account termination and legal action.

Trading Terms

The following terms govern all trading activities on the StratioFX platform:

Order Execution

  • Market orders executed at next available price
  • Limit orders filled at specified price or better
  • Stop orders become market orders when trigger price reached
  • Slippage may occur during periods of high volatility

Market Conditions

  • Prices derived from multiple liquidity providers
  • Spreads may widen during news events or low liquidity
  • We reserve right to adjust leverage during volatile periods
  • No guarantee against gaps in pricing or fast market moves

Fees & Charges

  • Commission and fee structure detailed in Pricing section
  • Overnight financing charges apply to positions held past settlement
  • Inactivity fees may apply after 3 months of no trading activity
  • Currency conversion fees apply for account/base currency mismatches

Funds Management

  • Minimum deposit requirements apply (varies by account type)
  • Withdrawal requests processed within 1-3 business days
  • Third-party deposits/withdrawals prohibited without authorization
  • Negative balance protection provided for retail clients

Technical Issues

  • Not responsible for losses due to technical failures beyond our control
  • Must report platform errors immediately upon discovery
  • Maintenance periods will be announced when possible
  • Alternative access methods should be available during outages

Dispute Resolution

  • Trade disputes must be submitted within 24 hours of execution
  • We maintain comprehensive audit logs of all transactions
  • Final decision on disputes rests with StratioFX compliance team
  • Arbitration available for unresolved disputes (see Section 8.4)

Trading Disclaimer

Trading involves significant risk of loss and is not suitable for all investors. Past performance is not indicative of future results. The high degree of leverage can work against you as well as for you. You should carefully consider your investment objectives, level of experience, and risk appetite before deciding to trade.

Prohibited Activities

The following activities are strictly prohibited on the StratioFX platform and may result in immediate account termination, forfeiture of funds, and legal action:

Fraud & Misrepresentation

  • Identity Fraud: Providing false identification or documentation
  • Payment Fraud: Use of unauthorized or stolen payment methods
  • Manipulation: Attempting to manipulate prices or exploit system errors
  • Misrepresentation: Falsely representing relationship with StratioFX
  • Forgery: Creating or using forged documents

Regulatory Violations

  • Sanctions Evasion: Circumventing international sanctions
  • Money Laundering: Structuring transactions to avoid reporting
  • Tax Evasion: Willful failure to comply with tax obligations
  • Insider Trading: Trading based on material non-public information
  • Market Abuse: Engaging in market manipulation practices

Platform Abuse

  • Automation: Unauthorized use of bots, scrapers, or automated systems
  • Exploits: Taking advantage of system errors or latency arbitrage
  • Spamming: Excessive order placement to disrupt services
  • Reverse Engineering: Decompiling or modifying platform code
  • Denial of Service: Actions intended to disrupt platform operations

Zero Tolerance

Immediate account termination for violations

Legal Consequences

Serious violations may result in legal action

Monitoring

All activity is monitored for compliance

Intellectual Property

All intellectual property rights in the StratioFX platform and services are and shall remain our exclusive property:

Copyright

All content on the StratioFX platform, including text, graphics, logos, and software, is protected by copyright laws and international treaties.

Permitted Use: Limited license for personal, non-commercial use only

Trademarks

"StratioFX" and all related logos, product names, and service names are trademarks owned by us. All other trademarks are property of their respective owners.

Restriction: No use without express written permission

Software

The StratioFX trading platform and all related software contain proprietary and confidential information protected by intellectual property laws.

License: Revocable, non-exclusive, non-transferable right to use

Market Data

All market data provided through our platform is licensed for personal use only and may not be redistributed or used for commercial purposes.

Source: Data provided by third-party licensors with strict usage terms

Ideas & Feedback

Any feedback, suggestions, or ideas you provide regarding our services become our sole property without compensation or acknowledgment.

Assignment: All rights transferred to StratioFX upon submission

Enforcement

We will aggressively enforce our intellectual property rights to the fullest extent of the law, including civil and criminal remedies.

Remedies: May include injunctions, damages, and attorney's fees

Notice: Unauthorized use of any StratioFX intellectual property may violate copyright, trademark, and other laws. If you become aware of any unauthorized use, please immediately notify us at [email protected].

Limitation of Liability

To the maximum extent permitted by applicable law, StratioFX and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall our aggregate liability exceed the greater of $100 or the amount you paid us in the past twelve months for services giving rise to the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of these limitations may not apply to you.

No Warranty

Services provided "as is" without warranties of any kind

Governing Law & Dispute Resolution

These Terms and any disputes arising out of or related to them or the Services shall be governed by and construed in accordance with the following provisions:

Applicable Law

  • Jurisdiction: Laws of Saint Vincent and the Grenadines
  • Forum: Courts of Saint Vincent and the Grenadines
  • International Laws: UNIDROIT Principles may apply
  • Conflicts: Local consumer protection laws may supersede
  • Severability: Invalid provisions severed without affecting remainder

Negotiation

  • First Step: Parties must attempt good faith negotiation
  • Timeframe: 30-day negotiation period required
  • Representation: May involve legal counsel
  • Documentation: All offers and communications documented
  • Confidentiality: Negotiations are without prejudice

Arbitration

  • Forum: International Chamber of Commerce (ICC)
  • Location: London, United Kingdom
  • Language: English
  • Rules: ICC Arbitration Rules
  • Binding: Decision final and not appealable

Class Action Waiver

All claims must be brought individually

Time Limitation

Claims must be filed within 1 year

Costs

Each party bears own costs unless arbitrator decides otherwise

Miscellaneous Provisions

The following additional terms complete our agreement:

Language

The English language version of these Terms shall control in all respects. Any translations are provided for convenience only.

Conflict: English version prevails in case of discrepancies

Notices

We may provide notices through the platform interface, email, or postal mail. You consent to electronic communication for all purposes.

Effective: Notices deemed received 24 hours after sending

Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms without restriction.

Change of Control: Terms bind successors and permitted assigns

Entire Agreement

These Terms constitute the entire agreement between you and StratioFX regarding the Services, superseding prior agreements.

Incorporation: Includes Privacy Policy and other referenced documents

Waiver

Our failure to enforce any right or provision will not be deemed a waiver. Waivers must be in writing to be effective.

Non-Waiver: Single waiver doesn't affect future enforcement

Severability

If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

Reformation: Court may modify invalid provisions to make enforceable
